TERMS AND CONDITIONS OF MANDATE OF LEASE
Hollywood Mansion (Kevin Moss ) is of the owner for the purpose of this rental agreement of 21 Fulham Road Camps bay.
The lease agreement in terms of which the premises are let to the lessee is between the lessee and the Owner, This lease agreement comes into effect and will be binding on the lessee and the Owner on receipt of a confirmation of reservation signed by the lessee. Once the lease agreement comes into effect , together with the deposit, the Owner is to ensure that the premises may not be rented or otherwise made available to any other person and must remain exclusively available for the Lessee for the period between the Arrival Date and Departure Date (both inclusive).
The owner will ensure that the premises are clean in good order and condition and suitable to be let as executive accommodation. It is agreed that Contractors, eg Garden Contractors, Window Cleaners, plumbers may from time to time, service the property in keeping with its maintenance programme. It is agreed no discount and or reductions in rate will be offered by the owner for any reason whatsoever either prior, during or post arrival. The Tenant indemnifies the Owner from any constructional work happening around but not on the “Premises’. . Absolutely no Film or Photo Shoots are permitted without written consent from the Owner, and subsequent fee paid in full
Upon termination of the Lease the Owner shall be entitled to apply the deposit or any portion thereof towards the reduction of any sums due under this Lease against damages, breakages, repairs or costs or unpaid rental. Any balance remaining shall then be refunded to the Lessee by means of Paypal, Credit Card or cash on departure.
The Owner shall not be responsible for any injury, accident or damage which may at any time be suffered by the Lessee, his employees, servants, invitees, or visitors or any other persons whatsoever, or any of their property by any act, neglect or default by the Owner nor of any servant of the Owner or of any other Lessee in the premises and therefore the Lessee hereby indemnifies the owner against any and all claims by the lessee, its guests, visitors, invitees, family members, friends, and associates In particular the Owner shall not be responsible for any loss which the Lessee or any other person as aforesaid may suffer through theft or burglary, whether or not such loss be occasioned by any act, neglect or default of any servant of the Owner or any other Lessee in the premises
It is noted that if your booking includes children that you are forewarned of the risk associated with an insecure pool, & river bridge and as such the owner will bear absolutely no responsibility nor accept any liability for whatsoever reason in the event of any personal injury or any injury of any nature to any of the Lessee’s, their visitors, contractors or any other person whatsoever.
INCLUSIONS:
ALL household contents and movables, including, but not limited to linen, utensils, and furnishings;
Cable TV (100 Channels)
Electricity and gas;
Housekeeping services by the employees of the Owner; Monday- Friday ( Overtime Saturdays R 200. Sundays & Public Holidays R 400 p/ person
Accommodation for up to 6 Persons.
Shampoo ,Soap, Towels & Linen
EXCLUSIONS:
Breakages of any kind or nature;
Food and beverages; (Bar at personal expense to guest)
Telephone calls/charges;
Staff overtime services (weekends, and events after 18h00); If Required: Overtime rate at R200 p/day/pp. Public Holidays is double time. See above
Events of any kind or nature exceeding 20 pax in total. *
Up to 3 Gigs of Internet Access. Thereafter R 450 per Gig

Under-floor Heating at R 450 P/day (Master Bathroom U/F Heating not operational)
SPECIAL CONDITIONS
*In the interest of Neighbours being a tranquil residential suburb, the Lessee shall comply with the Municipal by-laws of the City of Cape Town with respect to public disturbance restrictions. Should any nuisance, or noise, be caused by the lessee, its associates, friends, family contractors, or guests the Lessee will be liable for criminal prosecution under the City Council & Municipal By Laws and Laws of South Africa, and may be evicted without notice.
* With respect to neighbours and adjoining property owners and tenants, NO events and or functions is Permitted in the property whatsoever. . No events are permitted over 15 people, incl caterers staff, barmen photographers, etc. i.e total persons on property. THIS IS NOT NEGOTIABLE. Should any events, functions, parties, occur the Lessee and its guests acknowledges this may result in an eviction and arrest, without notice.
No PA Systems, Live Bands, Microphones’, and Speakers are permitted under any circumstances.
The lessee agrees that no more than 10 persons is permitted to reside at the Premises. Any persons above 10 pax will be charged at ZAR 1,200 p/p per night, irrespective of age. No additional supplies or bedding will be provided for any extra person/s. The Lessee is hereby responsible for payment for any extra person/s
No Smoking is permitted indoors.
The owner has a right to release the booking should the indicated deposit not have been received within 7 working days from today.
Hollywood Mansion cancellation policy to the lessee is as follows:
· Non arrival without cancellation will be charged the FULL rental amount
. If Cancelled after Deposit has been received and 2 days prior to arrival The owner agrees to refund 25% of the full rental amount
· Should the Client arrive at a later date than stipulated on arrival date, and or check out on an earlier date than booked on this form the client is still responsible for payment of the confirmed full length booking.
It is recorded that this document constitutes the entire agreement between the parties and no variation or amendment thereto shall be valid unless reduced to writing and signed by both parties.
